These General Terms and Conditions of Sale (GTCS) govern the rights and obligations of Balimmo Development Group, an Indonesian company, and its client (individual or legal entity) in connection with the sale of the services offered by Balimmo Development Group. These GTCS apply to all service orders placed with our company.
These GTCS are drafted in accordance with the provisions applicable in Indonesia and with international commercial best practices.
These GTCS are systematically sent and made accessible to each client on our website www.balimmo.fr.
Ordering a service implies the client’s full acceptance of these GTCS for the entire duration of the mandate. No particular condition may prevail over these GTCS, unless expressly agreed in writing by Balimmo Development Group.
Fees are set internally by the agency. For all transactions concluded through Balimmo Development Group, agency fees are, except in special cases, payable by the seller.
Agency fees are included in the sale price displayed on the listings. You can consult our detailed fees in the corresponding section of these GTCS or upon simple request.
All transactions carried out through Balimmo Development Group are performed via a notary licensed in Indonesia or any other legally authorized party in accordance with Indonesian legislation.
The performance of Balimmo Development Group’s obligations is suspended in the event of a fortuitous event or force majeure preventing their execution. The agency will inform the client as soon as possible of the occurrence of such an event and will take all reasonable measures to limit the consequences.
If the mandate is concluded off our agency premises or remotely, the client has a right of withdrawal within 14 days following the signing of the mandate.
To exercise this right, the client must notify their decision in writing (by email or postal mail) to Balimmo Development Group. This right of withdrawal terminates the contractual obligations between the parties.
Any withdrawal after the expiry of this period must comply with the conditions set forth in the signed mandate.
Balimmo Development Group may connect its clients with partners (architects, contractors, inspectors, brokers, etc.) able to offer services suited to their needs.
The responsibility for the services provided by these partners rests exclusively with them. Balimmo Development Group does not intervene in the performance of the services provided by these partners.
These GTCS are governed by Indonesian law. In the event of a dispute, the client and Balimmo Development Group undertake to attempt to resolve the dispute amicably.
If no solution is found, disputes will be submitted to the competent jurisdiction in Indonesia.
